Terms of Service

You must be at least 16 years old to use Capture. By creating an account or using the Service, you represent that you meet this age requirement.

Event hosts must create an account to use Capture. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Guest participants do not need accounts. Guests access event galleries via QR code and provide only a display name to contribute photos.

You agree not to use the Service to:

• Upload content that is illegal, harmful, abusive, harassing, defamatory, or obscene
• Upload content that infringes on the intellectual property rights of others
• Upload content depicting minors in an inappropriate manner
• Use the Service for any commercial purpose unrelated to personal event photo sharing
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Circumvent access controls or security measures
• Upload malicious software or content designed to disrupt the Service

Event hosts are responsible for moderating the content in their galleries. We reserve the right to remove content that violates these Terms and to suspend or terminate accounts for repeated violations.

You retain full ownership of all photos and content you upload to Capture. We do not claim any intellectual property rights over your content.

By uploading content, you grant us a limited, non-exclusive license to store, display, and transmit your content solely for the purpose of providing the Service. This license ends when you delete your content or your account.

We do not use your photos for advertising, AI model training, or any purpose beyond providing the Service to you.

Capture offers both free and premium subscription tiers. Subscriptions are billed through the Apple App Store or Google Play and are subject to the respective platform's payment terms and refund policies.

Free events include core functionality with a photo limit. Premium subscriptions unlock unlimited uploads and additional features. Details and pricing are available within the app.

You may cancel your subscription at any time through your device's subscription settings. Cancellation takes effect at the end of the current billing period.

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your data.

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the app settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these Terms shall be resolved in the competent courts of Germany, without prejudice to any mandatory consumer protection provisions of your country of residence.
